Posner regarding the federal lawsuit filed by CVS Health seeking to block Tennessee’s newly enacted Freedom, Access and Integrity in Registered Pharmacy Act (Fair Rx Act ) which prohibits pharmacy benefit managers (PBMs) from owning pharmacies.
Tennessee is one of several states pursuing restrictions on PBM‑owned pharmacies. In May, Senators Elizabeth Warren and Josh Hawley reintroduced the Patients Before Monopolies Act which would prohibit joint ownership of PBMs and pharmacies nationwide.
Barry opined that Sen. Warren’s earlier version of the bill offered “the best chance of defeating control of pharmacy prices and distribution against PBM, private health insurance and private equity ownership of the entire vertical drug distribution market.”
