Overview

Commercial litigator and restructuring advisor in complex disputes.

David N. Saponara is a Partner at Kudman Trachten Aloe Posner LLP whose practice focuses on commercial litigation, bankruptcy, and restructuring.

David works with businesses and their owners at moments when strained relationships and hardened positions place decisions under the kind of pressure that can carry lasting consequences.

He represents clients across a wide range of industries (including finance, technology, healthcare, retail, real estate, and hospitality) and guides them through complex disputes from the earliest stages of evaluation through resolution – including litigation, arbitration, and restructuring proceedings. David frequently represents owners and stakeholders of closely held companies and investment partnerships, including business divorces and disputes centering on allegations of fraud, self-dealing, breach of fiduciary duty, misappropriation of trade secrets, shareholder oppression, and other internal misconduct where legal, financial, and personal dynamics are tightly intertwined. He focuses on structure, process, and the details that are often overlooked as conflicts escalate.

David also brings deep experience in bankruptcy and restructuring matters, representing debtors, creditors, and other parties in interest in complex bankruptcy proceedings, as well as out-of-court workouts and restructurings. He represents clients in high-profile, large-scale Chapter 11 cases as well as smaller matters, guiding them through the financial distress of key business partners, suppliers, or customers. Drawing from his early experience at a boutique bankruptcy firm, David provides pragmatic, efficient counsel that helps clients navigate challenging situations, protect their interests, and achieve favorable outcomes whether facing their own financial difficulties or those impacting critical relationships. He also collaborates with the firm’s transactional team to address litigation and insolvency risks in deal structuring and corporate matters.

David prides himself on providing practical, commercial-focused counsel to help clients realistically assess their goals and fully understand the downstream effects of any decision.
