Representative Matters

  • Played a key role in defending a client in a bench trial in the Central District of California involving claimed damages exceeding $18 million, including drafting pre- and post-trial briefs advancing a novel damages theory that was adopted by the court, resulting in an award of only $1 in nominal damages.
  • Successfully drafted a motion to dismiss in New York Supreme Court, securing dismissal of breach of contract and related claims seeking millions of dollars in damages against a real estate developer, along with dismissal of all claims against the client’s principal for failure to plead veil piercing.
  • Drafted and argued a motion to dismiss or stay in New York Supreme Court on behalf of a prominent Hollywood producer, successfully persuading the court to stay the action in favor of parallel proceedings abroad based on principles of international comity.
  • Successfully obtained dismissal of a claim for conspiracy to commit fraudulent conveyance, persuading the court on reargument that such a cause of action is not cognizable under New York law.
  • Conducted key legal research and briefing that was adopted by the court in rejecting an attempt to revive time-barred claims through a novel “part-payment” theory.
